Brief Description on Grievance:
Sir/Madam, I had submitted an application to Pala Municipality seeking a Building Permit for the construction of a proposed two-storied commercial-cum-residential building with a total built-up area of 55.8 sq.m. on a plot owned by me, having an extent of 0.7 Are (70 sq.m.). The application was rejected with the remark that a 5 metre rear setback should be provided as per the “Green Strip” provision in the Pala Master Plan, since the subject property shares its rear boundary with the Meenachil River. In this regard, I respectfully submit that the total depth of the plot from the road on the front side to the river on the rear side is only 9.6 metres. If a 5 metre rear setback for the green strip and the standard 3 metre front setback are insisted upon, the remaining space available for construction will be only 1.6 metres, which makes the construction of any building practically impossible. It may also kindly be noted that there are existing buildings on both sides of the subject property, and none of them maintain a 5 metre rear setback from the river side. Hence, strict enforcement of the above condition in this particular case would render the plot unusable. Further, the plot is a small holding of only 0.7 Are, and as such it may kindly be considered under the provisions applicable to small plots where relaxation of setback requirements may be granted, considering the physical constraints and practical difficulties involved. Since the property is located in a commercially important area and is surrounded by existing developments, leaving the plot vacant would serve no practical purpose and would cause undue hardship to the owner. I also hereby undertake that in the event of any future requirement arising in connection with the implementation of the Green Strip or river protection measures, I shall comply with the directions of the competent authority, including demolition of the structure if required. In view of the above facts and circumstances, I humbly request that the application may kindly be reconsidered and suitable relaxation may be granted to enable construction on the said plot.
